Lowe currently homeless and EGL Properties did not allow proper time or access for Lowe to collect personal belongings. All of Lowe's personal belongings were trashed and maintenance/workers haggled over things like Lowe's piano, dressers, antique furniture.

BET TZEDEK LEGAL SERVICES DUMPED LOWE WEEKS BEFORE TRIAL


Bet Tzedek legal Director Cynthia Chagolla and Attorney Casey Raymond positioned Lowe to relieve Bet Tzedek from representing him just weeks before his trial. In exchange, Lowe would receive all case notes & trial prep docs. If he did not grant release from representation, he would NOT get case notes/docs and Bet Tzedek would not represent him anyway.

HIGH LEVELS OF MOLD THROUGHOUT APARTMENT


Two independent tests performed at Lowe's expense showed positive results for HIGH LEVELS OF MOLD throughout apartment. Los Angeles Dept of Publici Health approved a few brush strokes of paint as a cosmetic fix.

HEATER REMOVED, EXPOSED INTERIORS/EXTERIORS LEFT FOR OVER A WEEK


Service technician hired by EGL Properties left hole in wall for over a week in apartment. OPEN GAS LINE remained when they removed heater.

MAJOR WATER RETENTION THROUGHOUT BUILDING


Water retention side of building causing heaving. Lowe's apartment floors wet, Discussions for 2+ years about retrofitting and what to do. BH Code approved PAINT PROJECT so plaster & lath were ripped out, mold left inside and covered back up to seal for cosmetic purposes

INITIAL SKIN ISSUES/BREAK-OUTS REPORTED MID SEPTEMBER

Lowe reported insect issues early-mid Sept 2018, no remediation. First exterminator was called 4-5 weeks later, no treatment. Second exterminator NO-SHOWED TWICE.
EBL PROPERTIES LIED TO CITY OF BEVERLY HILLS TELLING THEM BUILDING WAS JUST TREATED. IT WAS NOT.

WET FLOORS SEEPING FROM GROUND UP DUE TO WATER RETENTION IN BUILDING PRIOR TO RAINS, WORSENED BY RECENT RAIN

Wet floors seeping from ground up. Mold cited by LA County Dept of Public Health.


IMPROPER STORAGE OF POTTING SOIL/FERTILIZER MATERIALS

Improper storage of fertilizer and potting soil, against side of building. High nitrogen can be a fire hazard, decomposing or moist soil leads to spiders, garden mites, fleas and termites. This has been reported.

WORKERS LEFT OPEN GAS LINE LEFT IN LOWE'S APARTMENT

After 4 months of not providing heat, EGL Properties finally contracted a 3rd party (hisplumbing.com Lic# 903938) and they left an OPEN GAS LINE IN THE APARTMENT.

DEMAND LETTER FROM BH PROSECUTING ATTY STEVEN ROSENBLIT MISDEMEANOURS APPLY IF DEADLINE NOT MET.

BEVERLY HILLS PROSECUTING ATTORNEY, STEVEN ROSENBLIT, sent demand letter to EGL Properties and property owners about providing heat BY FEB 14, 2019. Deadline was not met, neither were the next 3 extensions. No action taken on demand.

"I WON'T ALLOW THAT EITHER" SAID JUDGE CHESTER HOKRN WHEN LOWE BEGGED FOR LEGAL REPRESESNTATION. DEEMED REQJESTS ADMITTED KNOWING LOWE DIDN'T UNDERSTAND WHAT THAT MEANT.

jUDGE CHESTER HORN, Santa Monica Courtouse, denied Lowe a continuance to prepare for trial and moved swiftly to side with opposing counsel. Chester Horn also denied Loweo access to legal counsel and later denied Lowe self-care to be released in order to eat, and demanded Lowe answer his questions, positioned in a way that would condemn any of Lowe's answers.

OPPOSING COUNSEL UNPROFESSIONAL AND MANIPULATIVE

THE LAW OFFICES OF RICHARD DAGGENHURST ACTED UNPROFESSIONALLY, YELLING ACROSS THE COURTROOM FLOOR FOR THE CLERK NOT TO ACCEPT LOWE'S PAPERWORK, INTERRUPTUING LOWE'S OWN TIME WITH CLERK FOR FORMS, SUBMISSIONS, ETC. DAGGENHURST OFFICES SENT THEIR DISCOVERY PAPERWORK TO A "LOST ADDRESS" WHICH THEY NEVER PROVIDED. Lowe asked attorney James D where discovery was sent. Concrete answer never preparedness for trial date, and Bet Tzedek legal services only committed to short term scgiven.will and Lowe was held against his

lLOWE REQUESTED DOCUMENTS FOR HIS TRIAL THAT HE DID NOT HAVE. SEVERAL REQUESTS WERE MADE AND THESE DOCUMENTS WERE EMAILED TO LOWE AFTER his trial.

EGL PROPERTIES MAKES IT DIFFICULT FOR LOWE TO COLLECT PERSONAL ITEMS

ONE EXAMPLE: Lowe in constant communication with Merline Martinez about clearing apartment on several occasions (with plenty of notice). Saturday May 18 Martinez did not communicate with Lowe for almost 7 hours and announced she did not find anyone to let Lowe enter.

EGL Missed reinspection date and concealed mold. Did not remove nor further research.

Lowe was present for work orders and witnessed workers using a dollop of bleach and a stroke of pai t over small mold area in bathroom.

PREVIOUS MOLD ISSUES REPORTED SEVERAL TIMES

Lowe has reported mold concerns on a number ,of previous occasions.

  • The original summons/complaint letter had several untruths including documenting and presenting that the property is not subject to rent control when in fact it is.

  • Lowe's apartment has a 5 window span along the back-side (the most windows along that side).   WINDOWS DO NOT CLOSE COMPLETELY, PROBABLY A 1" GAP IN EACH
  • EGL Properties lied to the city of Beverly Hills about maintenance and care which was not completed.
  • Lowe was faced with insect infestation concerns starting Sept 2018 that were never addressed, and were broght on by a number of (still) ongoing building safety and code conflicts

  • LA County Dept of Health has visited Lowe's apartment 3many times.  They have cited EGL Properties for water related issues, mold, etc. EGL as miossed several reinspection dates, and follow-ups.
  • Beverly Hills Code Enforcement visited property and cited EGL for heater and other building issues
  • EGL Properties has over 100 YELP reviews and 60+ are 1 star reviews. A history of improper tenanat care.
  • Dept of Public Health dismissed further mo,ld resesarch and admitted   "We are visual inspectors only. We don't tell owners how to fix okr repair anything."  
  • Lowe ran independent mold tests and both came back positive for HIGH LEVELS OF MOLD THROUGHOUT APARTMENT
  • Lowe constantly harassed by neighbor Isaiah Jenks
  • EGL Properties made it impossible/difficult for Lowe to re-enter apatment to retrieve personal belongings.  










BILLY LOWE HEALTH AFFECTED SINCE SUMMER 2018 DUE TO WATER RETENTION, NO HEAT, INSECTS IN BLDG, AND UNABLE TO WORK CONSISTENTLY ACCORDING TO HIS LICENSE AND CA CODE OF BUREAU OF BARBERING AND COSMETOLOGY

984. Disease and Infestation (a) No establishment or school shall knowingly permit a licensee or student afflicted with an infection or parasitic infestation capable of being transmitted to a client to serve clients or train in the establishment or school. (b) No establishment or school shall knowingly require or permit a licensee or student to work upon a client with an infection or parasitic infestation capable of being transmitted to the licensee or student. (c) Infections or parasitic infestation capable of being transmitted between licensee or student and client include, but are not limited to, the following: - Cold, influenza or other respiratory illness accompanied by a fever, until 24 hours after resolution of the fever. - Streptococcal pharyngitis (“Strep throat”), until 24 hours after treatment has been initiated, and 24 hours after resolution of fever. - Purulent conjunctivitis (“pink eye”), until examined by a physician or other licensed clinician and approved for return to work. - Pertussis (“whooping cough”), until five days of antibiotic therapy has been completed. - Varicella (“chicken pox”), until the sixth day after onset of rash or sooner if all lesions have dried and crusted. - Mumps, until nine days after onset of parotid gland swelling. - Tuberculosis, until a local health department authority states that the individual is noninfectious. - Impetigo (bacterial skin infection), until 24 hours after treatment has begun. - Pediculosis (head lice), until the morning after first treatment. - Scabies (“crabs”), until after treatment has been completed. (d) Blood-borne diseases, such as HIV/AIDS and hepatitis B (HBV), shall not be considered infectious or communicable diseases for the purpose of this section. (e) No person working or training in an establishment or school shall perform services upon a surface of the skin or scalp where such skin is inflamed, or broken (e.g., abraded, cut) or where a skin infection or eruption is present; nor shall a person working or training in an establishment or school perform services if the skin of his or her hands is inflamed, or broken, or where a skin infection or eruption is present, without wearing gloves.
